Definitions
- Employer: The individual or organization who has directed the employee to install and use the TrakLogger application. The employer is the owner of all data and has full administrative rights over the application and its use.
- Employee: The individual who has been instructed by the employer to use the TrakLogger application for work-related purposes.
- Personal Information: Any information that can be used to identify an individual, including but not limited to name, contact details, GPS location data, device identifiers, and employment information.
- Non-Personal Information: Data that cannot be used to identify an individual, such as aggregated usage statistics, device type, or anonymized analytics data.
- Geofence: A virtual perimeter for a real-world geographic area, defined by the employer, used to trigger location-based events in the application.
- Check-in/Check-out: The process by which an employee records the start and end of their work period using the TrakLogger application.
1. Ownership and Rights
- All data, logs, and information collected, processed, or stored by the TrakLogger application are accessible by the employer.
- The employer retains full rights to access, audit, modify, or delete any data within the application at any time.
- All intellectual property, including but not limited to the application code, design, and documentation, remains with the employer or its licensors.
2. Employee Access and Responsibilities
- Employees are granted access to the application solely for the purpose of fulfilling their work-related duties as defined by the employer.
- Employees must use their provided credentials and must not share access with unauthorized individuals.
- Employees are responsible for ensuring that all check-in and check-out actions are performed accurately and honestly.
- Employees must not attempt to disable, bypass, or interfere with location tracking, geofencing, or audit logging features.
3. Application Features and Data Handling
- The application continuously logs GPS location data while the employee is checked in. This data is uploaded to the employer’s server and may be used for monitoring, auditing, and compliance purposes.
- When in geofence mode and checked out, location data is stored only on the device and is not uploaded to the server.
- The application supports automatic check-in and check-out based on geofence events at employer-defined sites.
- All check-in, check-out, and location events are timestamped and may be audited by the employer.
- Employees may view their own check-in history and audit logs but may not modify or delete any records.
- By using the application, employees acknowledge and consent to continuous location tracking, check-in/check-out event logging, and audit logging as described.
4. Confidentiality and Security
- Employees must maintain the confidentiality of all information accessed through the application.
- Disclosure of any application data or employer information to unauthorized parties is strictly prohibited.
- Employees must promptly report any suspected security breaches or unauthorized access to the employer.
5. Restrictions
- Employees may not reverse engineer, copy, modify, or attempt to extract source code or data from the application.
- Use of the application for any purpose other than those explicitly authorized by the employer is forbidden.
- Employees must comply with all employer policies and applicable laws regarding data privacy and monitoring.
6. Termination of Access
- The employer may revoke or modify employee access at any time, with or without notice.
- Upon termination of employment or reassignment, all access to the application and its data must cease immediately.
7. Liability
- The employer is not liable for any unauthorized actions taken by employees in violation of these terms.
- Employees are personally responsible for any misuse or breach of these terms and may be subject to disciplinary or legal action.
8. Acceptance
Use of the TrakLogger application constitutes acceptance of these terms. Continued use is conditional on ongoing compliance.
