1. Acceptance of Terms

By accessing or using the TrakLogger service, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this site.

2. Description of Service

TrakLogger provides field staff management, location tracking, and analytics services ("Service") to businesses and organizations. Our Service includes mobile applications, web platforms, and associated APIs designed to help organizations optimize field operations.

The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue the Service at any time without notice.

3. User Account Registration and Security

To access certain features of the Service, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for any activities or actions under your account. You must immediately notify TrakLogger of any unauthorized use of your account or any other breach of security.

Subject to these Terms, TrakLogger grants you a limited, non-exclusive, non-transferable license to access and use the Service for your internal business purposes.

By using our Service, you acknowledge that TrakLogger collects and processes geolocation data from field staff. As the employer or organization administrator, you represent and warrant that:

6. Payments and Subscription

Certain aspects of the Service may be provided for a fee. You will be required to select a payment plan and provide accurate payment information. By submitting payment information, you authorize TrakLogger to charge your payment method for the selected plan.

All fees are exclusive of taxes, which you are responsible for paying. Payments are non-refundable except as required by law or as explicitly stated in these Terms.

Subscriptions automatically renew unless canceled at least 30 days before the end of the current subscription period.

7. Content Ownership and Intellectual Property

You retain all rights to the data you input into the Service ("Your Data"). You grant TrakLogger a license to use, modify, and distribute Your Data solely to provide and maintain the Service.

TrakLogger owns all right, title, and interest in and to the Service, including all associated intellectual property rights. No rights are granted to you other than as expressly set forth herein.

8. Disclaimers and Limitations of Liability

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. TRAKLOGGER DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL TRAKLOGGER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

9. Indemnification

You agree to defend, indemnify, and hold harmless TrakLogger and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

10. Termination

TrakLogger may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including without limitation if you breach the Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

12. Changes to Terms

TrakLogger reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

Note: TrakLogger and TeamLogger are products built by the same company, operating under consistent terms and conditions.
